Reviewing a POD IP takedown notice with qualified advice

Preserve an incoming POD IP notice, identify the claimed right and prepare design records before choosing a platform response with advice.

When a POD listing receives an IP takedown notice, preserve the notice and affected design records. Identify the claimed right, the material named, the platform action and any response deadline stated in the notice.

If ownership, licensing or alleged infringement is disputed, or a formal counter notice is being considered, ask a qualified Australian IP lawyer to review the case before making a legal declaration. Brief the lawyer with the notice, dates, platform status and relevant records.

Confirm the notice and its effect

Keep the original platform message, listing ID, date received and related email. Confirm an unexpected email in the platform account before following its instructions or using its contact details. Check whether the platform removed a listing, disabled specific content or warned of future action, and record any affected open orders separately.

Identify the complainant, the right claimed, the work or mark identified and the part of the listing said to infringe. A complaint about an illustration calls for different records from one about a product name. If the notice is too vague to identify the issue, record what is missing and ask the platform or lawyer how to clarify it.

Record any response deadline stated in the notice and when the platform action took effect. IP Australia First Response’s “Receiving a letter of demand” resource may help you organise your response to a demand. For copyright context, consult the Attorney-General’s Department page “For copyright users”.

Prepare the relevant record

Give the lawyer the listing and final production file as they appeared when the complaint arose. Include source files, applicable asset and font licences, contractor agreements, relevant customer permissions, artwork versions and correspondence. Mark what is confirmed and what remains uncertain, and preserve the underlying records while the matter is assessed.

Keep the evidence tied to the specific allegation. Permission for one graphic does not resolve a complaint about another element, and ownership of an illustration does not settle a claim about branding.

For a copyright allegation, include the Copyright Act 1968 (Cth) as a point for the lawyer to consider. Identify whether the notice concerns copyright, a mark or another kind of material rather than assuming one claim answers another.

Choose the platform route with advice

If the store lacks permission for the identified material, keep it offline while deciding how to correct affected listings. If the notice appears mistaken or overlooks a valid licence, assemble the supporting evidence before challenging it. Check the instructions that apply to the specific platform and case.

Etsy’s resource is titled “How to File a DMCA Counter Notice”. Shopify’s guide is titled “Reporting copyright infringement or responding to a copyright notice”. Read the relevant guidance and discuss the proposed response with the lawyer before proceeding.

A DMCA counter notice is a named response route in Etsy’s copyright guidance; do not assume it applies to a complaint about a different kind of right or to another platform’s process. A counter notice does not guarantee restoration, and the complainant’s legal action and the platform’s process can affect the result.

Discuss the counter notice’s statements and consequences with the lawyer before filing. Record the decision, advice, correspondence and final platform state, and keep customer updates tied to what can actually be supplied.

Before publishing a revised design, check its production file and listing images, and review other listings using the questioned asset.
